Legal Frameworks for ICTs 2012

The Commonwealth Secretariat and the Ministry of Foreign Affairs, Malta is pleased to announce another of the six training courses taking place under the Malta Commonwealth Third Country Training Programme.

The Course aims to:

Sensitise policy-makers and senior public service managers to a comprehensive range of legislative and regulatory issues that need to be addressed to facilitate the mainstreaming of ICTs into socioeconomic development;
Illustrate different approaches taken and experience gleamed through the adoption of various model laws and regulatroy mecchanisms;
Provide a roadmap and tool set for the systematic enactment of a comprehensive and mature Cyberlaw framework;
Provide an understanding of emerging issues and contemporary international dialogue on issues such as Broadcasting and Interconnection, Internet Governance, Cybercime and Jurisdiction.

The Course is organised by the COMNET Foundation for ICT Development, and is held in Malta. Course dates are from the 11th – 16th of June 2012. Applicants must be nominated by their employing department/ministry/organisation, and should be duly endorsed by their Commonwealth Point of Contact.

Application deadline is the 3rd of March, 2012.

Course Objectives

The course of Legal Frameworks for ICTs aims to:

sensitise policy-makers and middle management to a comprehensive range of legislative and regulatory issues that need to be addressed to facilitate the mainstreaming of ICTs into socio-economic development.
illustrate different approaches taken and experiences gleaned – through the adoption of various model laws and regulatory mechanisms.
provide a road-map and tool set for the systematic enactment of a comprehensive and mature Cyberlaw framework.
provide an understanding of emerging issues and contemporary international dialogue on issues such as Broadcasting and Interconnection, Internet Governance, Cybercrime and Jurisdiction.

Resources & Methodology

Resource-persons will be drawn from Malta, the Commonwealth Secretariat and internationally. Materials will include comparative models including UNCITRAL, EU Law and Commonwealth Model Law. Also a CD with rich content on the subject matter will be compiled for distribution to delegates as a knowledge resource.

Lectures, group-work, case-studies and guest-speaker presentations will be employed. In addition, delegate networking will be encouraged and allowed for in the course structure and timings.

Certificates

Certificates of participation will be awarded to participants completing the entire programme. The certificates will be issued by the COMNET Foundation of ICT Development together, the Commonwealth Fund for Technical Cooperation (CFTC) and the Ministry of Foreign Affairs of the Government of Malta.

This training course is intended for senior and middle-management delegates from legal and policy as well as operational units. Non-Commonwealth participants are also invited to attend. Discussion will be in English and any Commonwealth delegate-support will be limited to Commonwealth candidates.Sponsorships offered under the terms of the Malta-Commonwealth Third Country Training Programme and the Commonwealth Fund for Technical Co-operation cover course fees and hotel accommodation on a half-l board basis (breakfast and lunch) Not sure you wish to include dinner. Is this part of your consolidated programme? Sometimes participants like to get out after spending the day together? If you confirm full board, we will have to reduce the allowance. , except for the weekend, when a subsistence allowance is being made to allow for flexible individual arrangements. Sponsored participants will be granted a one-time subsistence allowance of Euros 100.

Accommodation is covered from Sunday 6th of June to Saturday 12th of June 2010 (6 nights). Participants and/or their ministries are responsible for : spending money for incidental expenses during the workshop (telephone, laundry, etc.). A suggested amount of Euros 25 per day is recommended; accommodation and living expenses beyond the 6 nights sponsored or covered by the course fees.

Background of Legal Frameworks

The link between ICTs and Development is acknowledged within the political agendas of most international and national fora. The Commonwealth Heads of Government Meeting held in Malta in 2005 emphasised this relationship in an explicit declaration mandating initiatives to counter the Digital Divide. This has subsequently translated into a programme known as Commonwealth Connects (www.commonwealthconnects.net).

Legal and regulatory infrastructures are recognised as a crucial component and enabler in the adoption of ICTs for Development. A plethora of issues needs to be addressed by both developing and developed countries, spanning areas such as the commercial environment, data-protection and freedom of information, regulation of the telecommunications sector and competition law and, not least, governance of the Internet.

COMNET (previously COMNET-IT) has been active in capacity-building in this area. Additionally, the Commonwealth Secretariat has promoted the issue as a key programming item and has also collaborated with COMNET in capacity-building activities.

Building on their experiences COMNET, on behalf of the Government of Malta and in association with the Commonwealth Secretariat are organising the 4th edition of an intensive pan-Commonwealth workshop.

Cyberlaw and its associated areas underpin the development of national strategies for knowledge economies, which is one of the main thrusts of the Commonwealth programme.
